Booking Terms & Conditions
Accommodation bookings made through Whitebeach Holidays Limited are governed by the following Terms and Conditions:
Terms of Payment
Your contract with us will come into existence when we receive your deposit of 35% of the total accommodation cost, payable within 3 working days of taking your booking. The balance must be paid 8 weeks before your scheduled date of arrival. We reserve the right to regard the booking as cancelled if the balance is not received by then and will be entitled to retain any deposit paid. If the booking is made within 8 weeks of arrival full payment must be made at the time of booking and the contract between us comes into effect upon our receiving payment.
We accept payment by credit or debit card during office hours, or by bank transfer. Contact us on 0871 218 0101. Please be advised there will be an additional 1.5% bank charge made on each credit or debit card payment. (note: bank charge not WBH).
A refundable Damage Deposit may be levied subject to the property you have booked. This must be paid on arrival in resort, and will be refunded to you upon departure once it has been confirmed that there is no damage to any areas of the Property. Cleaning services not agreed in the booking contract must be paid in resort.
It is a condition of booking that you have comprehensive travel insurance. Except for personal injury or death caused by our negligence we cannot accept any responsibility for medical expenses, costs of repatriation, loss or damage to possessions or any other costs, losses or damages of the kind which would be covered by a travel insurance policy.
All costings are subject to final confirmation as detailed on the booking form, which you will receive from us confirming your stay. Errors and omissions are excepted.
Cancellation by You
Cancellation must be in writing by lead name and sent by recorded delivery to: Mr W. Pemberton, WhiteBeach Holidays Ltd, Nicholas House, River Front, Enfield, EN1 3FG, UK or by email to email@example.com with request for a delivery receipt. Cancellation of accommodation will apply from the date of receipt by us of the written cancellation notice or email. If we receive the notification of cancellation more than 56 days before arrival, only the deposit will be retained by us. Otherwise the following cancellation charges will apply:
• 36-56 days before arrival 50% of the total cost will be retained.
• 22-35 days before arrival 75% of the total cost will be retained.
• 21 days or less before arrival 100% of the total cost will be retained.
These cancellation charges apply even if you are prevented from travelling to your holiday destination, or from taking your holiday, by an event of force majeure as described below. You must rely on your holiday insurance in such cases.
Cancellation by Us
In the very unlikely event that specific accommodation ceases to be available as booked and we are unable to offer you equivalent alternative accommodation we will refund you all the money paid (including the deposit) but no other compensation. If we cancel due to non-payment of monies or other breach by you, the above charges will apply from the date of cancellation by us and we will be entitled to claim or retain the balance due.
We shall have no liability to you under the contract if we are prevented from or delayed in performing our obligations by events or acts or omissions beyond our reasonable control, including without limitation failure or disruption of any transport system, flood, storm, extreme weather, volcanic activity, atmospheric conditions, fire, strikes, lock-outs,or other industrial disputes(whether involving our work force or any other party),act of God, war, terrorist activities, riot, civil commotion, or any act of government or public authority.
It should be noted that we act only as agents to arrange the booking on behalf of the owner of the booked property and therefore, except for death or personal injury caused by our negligence we cannot accept responsibility for the condition of the accommodation or for any other loss or damage suffered.
We will do our best to help resolve your justifiable complaints regarding the accommodation. In the event of a complaint you should complain immediately to the Property Management Agent responsible for the Property or to us directly. If your complaint is not resolved to your satisfaction in resort you should complete a Complaint Report Form available from your local Property Management Agent, and forward it within 7 days of leaving the Property to: Mr W. Pemberton - WhiteBeach Holidays Ltd, Nicholas House, River Front, Enfield, EN1 3FG, UK.
6. Property Damage
Should any furnishings, fixtures, fittings or other items in the Property be lost or damaged during your stay, you will be required to make immediate cash settlement with the Property Management Agent responsible for the Property, for the cost of replacement or repair, plus any additional labour costs.
If, after the contract comes into effect, you wish to change any details of the booking (e.g. arrival date or accommodation) we will endeavour to comply. A fee of £20 per person will be charged for each amendment. If you wish to alter your arrival date, the cancellation charges as per condition 4 will apply.
8. Third Parties
We do not offer flights and the contract for your flights will therefore be between you and the airline or agent rather than with us and will be governed by the terms and conditions of the particular airline or agent. We can, however, recommend travel partners.
The maximum number of people occupying the accommodation must not exceed the number of people specified on the booking form. If on arrival there are more people in the party, or if more guests join throughout your stay at the Property, a charge of 75GBP per additional person per week will be levied.
The Property will be available from 3.00pm on the day of your arrival, unless agreed otherwise. Departure is 10.00am.
The minimum stay is three nights and may vary according to each Property.
WhiteBeach Holidays cannot be held responsible for works of construction or refurbishment to beaches, harbours, golf courses, roads, property or any other amenities carried out by any private or governmental entity. However we will endeavour to inform our guests of any potential disturbance, which may affect the quality of their holiday.
Each property is different in style and its facilities will vary depending on the Owner, but all properties meet our general standard with regard to basic amenities. Photographs on our website and in our marketing literature are only samples of the varied selection of properties we offer.
Each property advertised by WhiteBeach Holidays may have its own individual house rules relating to cleaning, smoking, pets etc., which must be adhered to.
We reserve the right to terminate your holiday due to misconduct by you or of anyone in your party, without recompense.
Waiver or delay by us to enforce any provision of the contract shall not be construed as a waiver of any of our rights under the contract.
Except as expressly provided otherwise the parties do not intend any term of the contract to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999.
Please be advised that Satellite television, wi-fi, water, gas and electricity supplies can sometimes be interrupted.
These Terms and Conditions shall be governed by and construed in accordance with English Laws and you agree to submit to the non-exclusive jurisdiction of the English Courts.
